Smoking
GCC Partners adheres to California and Federal laws regarding smoking. Below you will find our policy regarding smoking in and around our properties.
Indoors
There continues to be a no smoking policy within all our units, as outlined in our residential lease agreement. This includes all forms of smoking; tobacco and marijuana are both prohibited. This also includes vaping and any form of E-cigarette. Indoors also includes all garages. This policy is legally supported in California by Proposition 64. Violation of this policy will result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
Outdoors
There continues to be a no smoking policy in all common areas of our properties, as outlined in our residential lease agreement. Violation of this policy will result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
Medical Marijuana
Medical marijuana use is not allowed on the premises. Medical marijuana users are not considered a “protected class” under the American with Disabilities Act and therefore are still considered to be smoking. A medical marijuana card does not change this definition. Violation of this policy will result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
Common Area Use
Smoking of marijuana in any public place is illegal in California under Proposition 64. All areas outside of your immediate unit are considered public spaces and therefore marijuana use outdoors is not permitted. As this is a violation of California law, outdoor use of marijuana witnessed will result in the immediate involvement of law enforcement. Violations will also result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
Quiet Enjoyment
A fundamental tenant right, and one that is outlined in our residential lease agreement is the “Right to Quiet Enjoyment” of one’s residence. As second-hand tobacco and marijuana smoke are considered a nuisance by many, interference with other’s “Quiet Enjoyment” by smoking tobacco or marijuana is prohibited. Any complaints regarding the use or odor of Tabaco or marijuana from a tenant in the building will be considered a violation of the residential lease agreement. Violation of this policy will result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
Cultivation
Due to the high energy consumption and potential for mold and fungus, the cultivation of marijuana is prohibited in all our units. This is supported by the “Maintenance and Repairs Rules” section of the residential lease agreement. Violation of this policy will result in a 3-day notice which could lead to an unlawful detainer and eviction proceedings.
